Chain Reaction Leads To Four-Motorcycle Accident In Northern Virginia

By Kevin DuffanVirginia (VA) Injury Attorney

A chain-reaction motorcycle accident led to serious injuries being suffered by four riders out for a drive over the Memorial Day weekend. The accident took place in Northern Virginia on I-66 in Fairfax County.  The four men injured were: David Morris, Earl Leonard, Steve Thompson and Jamie Fireline.

According to the Virginia State Police, the accident began a little after 2 p.m. when one of the drivers lost control of his Honda FLU. The accident happened in a work zone, but troopers say there was no construction at the time of the collision. Two other motorcycles were unable to stop and ended up rear-ending the first motorcycle. A fourth motorcycle attempted to avoid the collision and ended up running off the left side of I-66, ultimately striking a guardrail.

Thankfully, the four men were all wearing helmets at the time of the accident. Police say because of the helmets, the men suffered much less severe injuries than would normally be expected.

According to numbers from the Centers for Disease Control, between 2001 and 2008, more than 34,000 motorcyclists were killed on the nation’s roadways. During that same time an estimated 1.2 million others were treated in emergency departments for non-fatal motorcycle-related injuries.

In Virginia, the most commonly seen injuries to motorcyclists involve those to impacting the head. Traumatic brain injuries and concussions are all too common, even in those who wear helmets. As the recent accident indicates, wearing a helmet dramatically improves a rider’s odds of surviving. In fact, studies show that if a motorcyclist is wearing a helmet at the time of a collision that rider’s risk of death is reduced by 37 percent.

If you’ve been injured in a Virginia motorcycle accident caused by another driver, it’s important that you turn to experienced attorneys who know how to handle your case. In one case, my firm was able to secure a $450,000 award for a client who was injured in an accident while riding his Harley to a nearby convenience store.

Head-On Collision In Fayette County Sends Five To Local Hospitals

By Randy Appleton, Virginia (VA) Injury Attorney

A three-car accident in Fayette County, West Virginia earlier this week left several people seriously injured according to a sheriff’s department spokesperson. Authorities say that a little before 10 a.m. this Monday the police received a 911 call regarding a three-car accident that took place on Sunday Road, near U.S. Route 60 in Hico, WV.

Emergency responders arrived at the scene and discovered that the driver of one vehicle was trapped in the car and needed the Jaws of Life to extract the man before he could receive medical treatment. Four other people involved in the accident were taken by ambulance to local hospitals. Police say while the specific condition of the victims is unknown, none are believed to be suffering from life-threatening injuries.

A preliminary investigation found that two vehicles driven by tourists were traveling south on Sunday Road when a third vehicle driven by a local man was heading north. Two of the cars then hit each other head-on near the crest of a hill, at which point, the driver of the third car attempted to steer off the road but lost control and crashed into the other cars.

So far, police have not released the names or ages of those involved. They also say they do not believe drugs or alcohol were involved in the accident. Police say they believe the cause of the wreck was that unfamiliar drivers were confused on a single-lane road.

As this case proves, head-on collisions are serious and have substantially higher fatality rates than other kinds of crashes, with the exception of rollovers. According to the NHTSA, two percent of crashes are head-on collisions, but these account for 10 percent of all fatal accidents. Head-on crashes more frequently result in death because of their abrupt nature; stopping forward movement so suddenly.

Norfolk, VA Tractor-Trailer Crash Results In Several Injuries

By Jim Lewis, Virginia (VA) Injury Attorney

Virginia State Highway Patrol says that they have launched an investigation into an accident that ended with a tractor-trailer overturning along Interstate 64 in Norfolk, VA.

Authorities with the state troopers say that the crash involved two vehicles, one of which was an 18-wheeler. The accident happened yesterday afternoon, just before 2 p.m. Police say the crash occurred in the westbound lanes of I-64 near Military Highway.

All westbound lanes were closed for several hours as emergency responders tended to those injured and tried to lift up the overturned tractor-trailer. Police say the semi was especially heavy given the weight of its cargo and that it took much longer than anticipated to get the truck upright. According to an accident report, the semi was carrying several thousand pounds of wood flooring.

Troopers say that the crash was caused in part by the extreme weight of the semi. Reports indicate that as the driver of the tractor-trailer was coming onto I-64 the weight in his tractor-trailer shifted. This shift was severe and, in an attempt to correct the shift, the rig ended up overturning.

Eyewitnesses have said that another vehicle crashed into the median in an attempt to avoid crashing into the truck and its cargo. Police say the driver of the passenger vehicle was taken to a local hospital for treatment of injuries, as was the driver of the tractor-trailer.

Nationwide, there was a 1.9 percent increase in the number of people killed in crashes involving large trucks from 2010 to 2011, the most recent years of data available from the National Highway Traffic Safety Administration. Though there are many causes for such accidents, drivers operating an overloaded vehicle are one common reason. Tractor-trailers are already large and difficult to control, but when they are packed with heavy cargo they can become almost impossible to safely steer.

My firm has successfully handled multiple cases against truck drivers and trucking companies that caused severe injury and death to innocent motorists in Virginia. In one case, my firm was able to secure a $650,000 jury verdict for a client who was injured in a serious wreck involving a MACK truck.

Elderly Driver Seriously Injures Dozens In Parade Accident

By Jim LewisVirginia (VA) Injury Attorney

A terrible accident took place over the weekend when authorities say a driver plowed directly into dozens of hikers marching in a parade in downtown Damascus, Virginia.

The accident, which took place during the Hikers Parade at the annual Trail Days festival on May 18th, left nearly 60 people injured. Officials say that the accident resulted in panic among many in the parade who feared for the worse. Three of the 60 injured suffered life-threatening injuries and had to be taken by helicopter to area hospitals. Several remain in critical condition according to authorities. Thankfully, no one died in the accident.

Police say they now believe that the accident that sparked the injuries was caused by a medical condition on the part of the driver and not the result of an intentional attempt to injure others. Police say at around 2 p.m. on Saturday and elderly man in a 1997 Cadillac who was participating in the parade suffered some sort of problem. The medical condition led him to accelerate the car to about 25 miles per hour where he then struck the crowd walking in the parade.

Though many are relieved to hear the accident was unintentional, some of the parade walkers have expressed dismay that the elderly man was allowed to participate at all. One witness says the man was driving because he could not walk in the parade which the man said raises questions about why he was allowed to drive a full-size vehicle rather than something less dangerous like a golf cart.

Tragically this was not the first time that something that was supposed to be a good time, like a parade, turned deadly. Just last year a train slammed into a parade float in Texas killing four people. Several years before that an elderly driver in California crashed his car into a farmer’s market, killing ten people.

Though this does not mean that older drivers should never get behind the wheel of a car, the man’s particular health condition may have been cause for concern. As the one witness pointed out, if he was truly too fragile to walk then maybe he should not have been driving such a large and powerful vehicle.

Those injured in the accident should contact an experienced Virginia personal injury attorney who has experience dealing with such auto accident cases. The attorneys at our Virginia accident firm have handled countless cases involving car accidents and have been able to secure much needed compensation for our injured clients.

Nissan Recalls Thousands Of Vehicles Due To Brake Defect

By Kevin DuffanVirginia (VA) Injury Attorney

What Happened:

Nissan says it is recalling 2013 Nissan Pathfinders and Infiniti JX SUVs after problems with the braking system were uncovered. The issue is a defective brake part that can fail under certain circumstances and make it hard to stop the car.

The NHTSA released a statement on the recall, saying it would affect some 20,000 vehicles. The cars that are in the recall were all made in late 2012 and early 2013 at the Smyrna, TN Nissan plant.

Nissan has said that the issue is with the front brake torque member, which was improperly cast. That error has resulted in structural weakness that can lead to premature failure. When failure occurs, the brake caliper can move around and touch the inside of the road wheel which reduces the ability of the driver to properly stop the car, thus greatly increasing the risk of a crash.

Nissan said it launched the initial investigation into the matter after a report was brought to its attention in March that the issue had resulted in a brake failure and accident.

Nissan will notify owners of the vehicles if they need to bring their vehicles in for an inspection and possible part replacement. If you have any specific questions, you can contact Nissan directly at 1-800-647-7261.

The Virginia Injury Attorney’s Perspective:

Though it’s always good to see a company take the step of warning consumers about possible dangers associated with its products, the recall by Nissan raises some serious questions about why the improperly assembled vehicles were allowed to be sold in the first place.

Attorneys with my Virginia (VA) personal injury law firm have helped victims of dangerous and defective products recover damages from companies whose negligence or disregard for consumer safety led to injuries. In one case, my firm represented a man who was injured as a result of a defect in a custom ski boat he had recently purchased. We were able to secure a settlement for the man to help compensate him for not only his medical expenses, but for the pain and suffering he endured as a result of the manufacturer’s negligent design.

3.4 Million Vehicles Recalled Due To Worries Over Airbag Shrapnel

By Randy AppletonVirginia (VA) Injury Attorney

What Happened:

A major recall was announced earlier this week that affects more than 3.4 million older model vehicles across a variety of brands. The recalls impact six carmakers, including Toyota, Honda and Nissan. The vehicles are being recalled after reports surfaced that defective airbags can send shrapnel flying into the passenger compartment of the vehicle, potentially injuring occupants of the car.

The recall impacts cars sold mainly by Japanese carmakers, though a small number of vehicles made by BMW and GM are also included. The airbags all contained parts from the same parts supplier, Japanese firm Takata Corporation. The automakers will be checking for airbags that have faulty inflator mechanisms that do not properly route compressed gas into the airbags. Instead of inflating the airbag, the faulty devices use gas to spray the interior compartment of the vehicle with plastic and metal parts. Takata announced the major recall after six reported incidents of airbags improperly deploying were brought to light.

The recall comes as unwelcome news for all the automakers, but especially Toyota which has been working to overcome a reputation for defects that began after the sudden acceleration problems surfaced several years ago. Since October of 2012, Toyota has issued four major recalls, each involving more than a million vehicles.

The latest recall involves a total of 1.7 million Toyota vehicles worldwide, including nearly 600,000 in North America. The models include the Corolla, Matrix, Sequoia, Tundra and Lexus SC 430 sports car, all made between 2001 and 2003. Honda has 1.1 million affected vehicles, including 680,000 in North America. Models include the Civic, CR-V and Odyssey minivan. Nissan is recalling 265,000 vehicles in the U.S., including the Maxima, Pathfinder and Sentra as well as several Infiniti models. Mazda, GM and BMW also announced recalls, though in much smaller numbers.

The Virginia Injury Attorney’s Perspective:

As we wrote about last month, airbag troubles are frequent causes for automotive recalls. The issue is not whether airbags save lives, a study by the National Highway Traffic Safety Administration showed that in one year airbags typically save upwards of 2,700 lives. The problem, in the case of many of these recalls, and in the recent Takata trouble, is making sure the airbags will inflate when they’re supposed to and that they do not inflate when they aren’t.
